ADR Consultation

 

Alternative Dispute Resolution (ADR) is an informal method of settling disagreements that may arise during the IEP process. ADR uses specific options within this process to open communication, promote understanding, and reach agreements that support and strengthen relationships. ADR is designed to meet the interests of the parties involved that result in a mutually agreeable outcome, rather than a decision solely made by a third party, hearing officer, or judge.

Services:

  1. Training Sessions
    HCR provides training for parents and district members in effective communication, de-escalation strategies for contentious moments, the methods of IEP facilitation, and other topics that build capacity for collaboration and managing conflict.

  2. Conflict Coaching
    HCR is available to conference with parents or district staff to intervene early, offer suggestions, and resolve concerns.

  3. IEP Meeting Facilitation
    A Facilitated Individualized Education Program (FIEP) meeting is an IEP meeting conducted by a trained, impartial facilitator. The facilitator leads the IEP team in a systematic process that helps parents and the LEA reach agreements while developing various components of the IEP. The responsibilities of the facilitator include setting an agenda, maintaining the focus of the meeting on the needs of the student and encouraging effective communication strategies among all team members.

  4. Formal/Informal Resolution Sessions
    Before or after parties file formal complaints or due process, HCR facilitates a session that brings the disputing parties together to reach a mutually satisfying agreement with the guidance of a trained impartial mediator. The session allows both parties to listen and express their point of view.

The mediator will help the parties try to find a solution that is acceptable to both parties. The parties decide whether or not the dispute is settled. When an agreement is reached, the specifics are put in writing and signed by all parties to signify the commitment of both parties to uphold the resolution.
